POLICIES AND PROCEDURES

 

DISCIPLINING OF MEMBERS, ASSIGNEES, DEPENDENTS AND GUESTS

I. GENERAL PRINCIPLES

The Club shall maintain a safe, respectful, and secure environment for all members, assignees, dependents, guests, officers, and employees.

II. POLICY STATEMENT

    1. To ensure that infractions in the Club Rules and Regulations, the By-Laws and/or other policies are reported.
    2.  To impose appropriate penalties for any reported infraction and/or breach of conduct.
    3. Penalties shall be commensurate to the gravity of the infraction, the circumstances under which it was committed, and the offender’s prior record.
    4. Due process shall be observed in all disciplinary proceedings.
    5. Penalties are progressive, except where the nature of the offense warrants immediate and severe action.
    6. The Board of Directors (BOD) may impose preventive suspension pending investigation when the continued presence of the offender poses a risk to safety, dignity, privacy, or Club operations.
    7. Club penalties are without prejudice to criminal, civil, or administrative liability under applicable laws.

III. ENFORCEMENT

    • Per the Club By-Laws, the Membership and Auction Committee shall process applications for membership; interview applicants to determine if they are qualified; ascertain that the requirements prior to membership are complied with; submit to the Board its recommendation on applicants for membership; take charge of auction sales of Certificates, establishing auctioning procedures; investigate complaints against members, and perform other functions authorized by the Board.
        1.  A complaint against any member, assignee or dependent MUST be in a form of writing by personal service or registered mail, addressed to the Membership Committee, through the Club’s General Manager.
        2.  A member, assignee or dependent shall be given an opportunity to be heard by the Membership Committee to show cause why he/she should not be disciplined. This shall be facilitated by requesting the said member to submit his/her explanation within ten (10) days after the Committee’s notice to the member.
    • Upon recommendation of the Membership Committee, except for cases requiring a Special Committee to decide on such matter, as mandated by the law (e.g. Safe Spaces Act), any member, assignee, dependent or guest may be suspended or expelled by majority vote of the Board of Directors (BOD), for any infraction of the Club Rules and Regulations, the By-Laws, or other regulations and/or resolutions of the Club, or for breach of conduct of members, dependents and guests, which the Board of Directors may deem disorderly or injurious to the interest of the Club, other members and employees of the Club.
    • When a member is suspended, his/her dependents and sponsored guests, shall automatically lose Club privileges. He/She, along with his/her dependents and sponsored guests will not be allowed to enter the Club premises during the suspension.
    • When a member is expelled, he/she WILL not be allowed to enter the Club premises. Further, an expelled member is forever disqualified from applying for membership or being a guest.
    • No member and assignee shall be entitled to a refund of any membership deposit, dues or any other fees on account of any such restriction, suspension or termination of membership privileges. During the restriction or suspension, dues and other charges shall continue to accrue and shall be paid in full prior to reinstatement as a member in good standing.
    • Applicable to Dependents: a dependent may be subjected to a warning, a suspension or cancellation of Club privileges for such period of time, or on a permanent basis, for committing infractions.
    • Applicable to Guests: Club privileges will be cancelled without notice to the guest. Offending guest is forever disqualified from applying for membership or being a guest.

IV. PENALTIES

The membership privileges may be restricted, suspended or terminated by the Board of Directors if in the sole judgment of the Board of Directors, the member, assignee, dependent or guest, subject to due process:

The Club shall observe the following graduated penalties for infractions committed by members, assignees, or guests. The penalties are progressive based on the severity and repetition of the offense.

Graduated Penalty Schedule by Offense Severity

1. MINOR INFRACTIONS

1.1 Definition – Acts involving non-dangerous misconduct or rule violations that cause minimal disruption and do not involve violence, harassment, criminal conduct, or data misuse.

Covered Infractions

      • Unsatisfactory behavior or improper conduct not involving threats or harassment
      • Unreasonable or disrespectful treatment of employees
      • Minor violations of Club rules and regulations
      • Bringing food without authorization
      • Unauthorized posting of materials on Club premises
      • Non-dangerous disruptive activities
      • Unauthorized photography or recording without malicious intent.

   2. MODERATE INFRACTIONS

2.1 Definition – Acts involving serious disruption, negligence, property damage, or repeat minor offenses, which expose the Club to risk but do not constitute violent or criminal acts.

2.2 Covered Infractions

      • Damage to Club property, whether intentional or due to negligence
      • Bringing pets without authorization
      • Illegal gambling; smoking or vaping in prohibited areas
      • Negligent handling of personal or sensitive personal information
      • Failure to report lost or stolen membership cards or access credentials
      • Unauthorized extraction or scraping of the Club’s membership directory
      • Repeated Minor Infractions escalated by the Membership Committee

*Where property damage occurs, the offender may also be required to shoulder the cost of repair or replacement, without prejudice to other penalties.

  3. SEVERE INFRACTIONS

3.1 Definition – Acts involving violence, harassment, criminal conduct, serious threats to safety or dignity, or intentional misuse of data or digital systems, whether committed once or repeatedly.

3.2 SAFE SPACES ACT–RELATED SEVERE INFRACTIONS (RA 11313)
The following acts constitute SEVERE INFRACTIONS and are subject to zero tolerance:

      • Verbal abuse, sexual remarks, or unwanted comments of a sexual or gender-based nature
      • Unwanted physical contact, gestures, or advances
      • Stalking, intimidation, coercion, or threats
      • Harassment through written, electronic, or digital means
      • Harassment committed within Club premises or through Club-related platforms

3.3 Proceedings shall ensure:

      • confidentiality
      • protection against retaliation
      • no forced confrontation between complainant and respondent

3.4 DATA PRIVACY–RELATED SEVERE INFRACTIONS (RA 10173)
The following acts constitute SEVERE INFRACTIONS:

      • Unauthorized disclosure of personal or sensitive personal information
      • Posting personal data on social media without authorization
      • Use of personal data for harassment, retaliation, or doxing
      • Unauthorized access to restricted systems or files
      • Identity misuse to grant unauthorized access
      • Intentional hacking, malware planting, or sale of member data

*Where required, the Club shall report notifiable data breaches to the National Privacy Commission (NPC).

  4. OTHER SEVERE INFRACTIONS

    • Possession, use, or influence of prohibited drugs
    • Unlicensed carrying or possession of firearms or deadly weapons
    • Physical fights, assaults, or violent acts

4.1 Penalty: Immediate preventive suspension, followed by termination or expulsion, and referral to authorities when applicable.

  5. MISREPRESENTATION AND IDENTITY MISUSE

5.1 Falsification or Misrepresentation

      • Falsified membership or guest information

5.2 Penalty:

Members / Assignees – Immediate Expulsion
Guests – Immediate cancellation of privileges and permanent disqualification

  6. Unauthorized Use of Membership Card or Identity

  7. APPLICABILITY OF THIS POLICY ON GUESTS AND DEPENDENTS

Guests and dependents are subject to the same classification of infractions.
Guests shall be informed of violations through the sponsoring member.
Guest privileges may be suspended or permanently revoked.
Guests who commit Severe Infractions are permanently barred from entry and future sponsorship.

  8. RETALIATION

Any act of retaliation against a complainant, witness, or reporting party — including harassment, intimidation, or misuse of personal data — shall be treated as a SEVERE INFRACTION, punishable by termination or expulsion.

  9. OTHER ACTS AND OMISSIONS

Any act or omission not expressly enumerated in this Policy, but which is analogous, similar, or comparable in nature, or which results in:

      • disruption of order within the Club;
      • harm or risk to the safety, security, dignity, or welfare of members, guests, employees, or the Club;
      • damage to the property or reputation of the Club;
      • violation of applicable laws, regulations, or public policy; or
        unauthorized use, disclosure, or compromise of personal or sensitive information
        shall likewise be subject to disciplinary action.

The Membership Committee and the Board of Directors shall have the authority to classify such act or omission as Minor, Moderate, or Severe, and to impose the appropriate corresponding penalty, guided by:

      • the most analogous infraction under this Policy;
      • the gravity and actual or potential consequences of the act;
      • the presence of intent, negligence, or malice; and
      • applicable laws, including but not limited to the Safe Spaces Act (RA 11313) and the Data Privacy Act (RA 10173).

All determinations shall be supported by substantial evidence and shall observe due process.

  10. BOARD DISCRETION AND ESCALATION

The Board of Directors may impose stricter penalties where warranted, provided decisions are supported by substantial evidence and due process.

Repeated Minor Infractions may be escalated to Moderate or Severe.
Severe Infractions may result in immediate expulsion, regardless of prior offenses.

  11. APPEAL

A suspended or expelled member or assignee may appeal in accordance with the Club By-Laws. The decision of the Proprietary Members shall be final.

  12. RESPONSIBILITY OF THE MEMBERSHIP COMMITTEE AND MEMBERSHIP DEPARTMENT

1. The Membership Committee must exercise due process at all times.
2. The Membership Department must document all complaints and decisions.
3. The Membership Department must treat all information in strict confidentiality.
